Welcome to Markowski Schellmann Rae OG. We advise and represent you and your company in connection with the insolvency of a property developer. We specialise in representing creditors and injured parties arising from the insolvency of the SIGNA Group.
Buyers: We support you as the buyer of a property developer or developer project in enforcing and securing your claims in insolvency proceedings. This includes, among other things:
- Enforcement of your claims in the insolvency proceedings;
- Advice on a possible takeover of the property development project;
- Negotiations with banks;
- Enforcement of your claims against any third parties;
Suppliers and contractual partners: Many companies have a direct contractual relationship with SIGNA, either as a supplier or service provider. The announced further insolvencies of companies in the group will inevitably lead to your claims (for payment, surrender, performance, etc.) having to be enforced in insolvency proceedings and, if necessary, against third parties (see below). We support and advise companies
- in enforcing and securing your claims in insolvency proceedings;
- in the recovery of goods subject to retention of title;
- in negotiations with the insolvency administrator;
- in enforcing your claims against any other third parties;
Employees: Unfortunately, a large number of employees will be affected by redundancies as a result of the site closures. As a rule, interest representatives will take over the representation (insolvency protection association for employees). Sometimes, however, specific questions arise that are beyond the scope of the Chamber of Labour's services because not all individual issues can always be dealt with. We are happy to support and advise you on your labour law issues.
Banks/investors: We also support banks and investors. We advise you on asserting your claims and realising your collateral. We also advise investors and banks in negotiations for acquisition or reorganisation financing.
Interested parties/assets: In the course of the insolvencies, there will be sales by the insolvency administrator(s) of assets, including probably various properties. If you wish to participate in the (anticipated) bidding process, we will be happy to support and advise you
- with the due diligence;
- Negotiations with the insolvency administrator;
- Drafting of the purchase agreement/trustee settlement
Claims against third parties: The insolvency of the SIGNA Group is likely to leave behind a great deal of damage. Injured parties can assert their claims not only against the respective SIGNA company in the insolvency proceedings, but also against any liable third parties. These may include managing directors, de facto managing directors, legal and tax advisors, existing investors and others.
